Terrance Tate has been in jail since April 2006 on a seventy-five thousand dollar bond for the beating death one year old Javonte Covington.
On Friday, Judge R. Scott Krichbaum ruled he will stay in jail without bond after hearing new evidence that Tate confessed to the murder.
Tate's original confession to the 2006 murder was thrown out on a technicality.
Now, prosecutors say they have evidence of another confession, a taped phone conversation of Terrance Tate from jail admitting the crime to his mother. Prosecutors say Tate is a flight risk and it's necessary to revoke the bond.
The defense says the hearing today could wait until Monday when Judge John Durkin, the judge who has been hearing the case, returns from vacation.
"Information that the state has presented today(Friday) is new information that Judge Durkin should consider in this matter. I think everybody agrees with that and admits to that.", states Judge Krichbaum.
Judge Krichbaum says he understood both sides and says Tate will now be held without bond and Judge Durkin will hear the new evidence when he return's next week.
