Benji Brown's is now officially closed.

LaShawn Ziegler, owner of the popular club, decided Tuesday morning that he was no longer going to fight the city's attempt to have his business declared a nuisance and shut down.

Ziegler and his attorney Gil Rucker, say they believe the city has targeted the nightclub. Ziegler pointed out his other bar, 77 Soul, was shut down for building code violations.

Rucker says there are several other bars in the city that have had more problems than Ziegler's but the city has not tried to close those establishments.

Atty. Greg Hicks and Prosecutor Traci Timko-Rose disagree, saying they are not targeting anyone.

Hicks also stated that the Ohio Investigative Unit, an arm of the Ohio Department of Public Safety, cited Ziegler for operating without a liquor license, which is a main reason the city wanted the establishment shut down.

Ziegler is facing misdemeanor liquor violation charges in municipal court. His attorney says he is innocent and they will be fighting the allegations.
