An injured worker who is entitled to workers' compensation benefits may settle his or her case. As an injured worker, you should not agree to settle or compromise your workers' compensation claim if you have not received an impairment rating from your doctor. You should know the extent of your permanent injuries, before agreeing to settle your claim. If you agree to settle your workers' compensation claim, you are compromising your right to future benefits should your situation worsen. You are also foregoing your right to receive weekly benefit payments in exchange for a lump sum settlement. Be sure that you fully understand your rights under the workers' compensation law of the state where you are employed, before agreeing to settle your case.
