Valley Killer on Death Row Asks for Retrial

A man sentenced to die Feb. 4 for killing an Ohio convenience store owner wants a new trial because he says a witness lied during testimony against him.

Lawyers for condemned inmate Mark Brown says new evidence shows a witness who testified against Brown now admits he was across the street when the slayings happened.

The 37-year-old Brown was sentenced to die for the 1994 killing of Isam Salman, owner of Midway Market in Youngstown.

Brown also received a life sentence for the fatal shooting of a store clerk, Hayder Al-Turk, during the same robbery.

Prosecutors say Brown hasn't offered proof the witness' statements would have changed the outcome of the trial.

Judge Maureen Sweeney of Mahoning County Common Pleas Court holds a hearing on Brown's request Jan. 15.
