It will be at least a month before a judge decides if another agency other than Trumbull County Children Services should take over custody of an infant that was allegedly raped during a supervised visit at the facility.

Atty. David Engler, who represents the infant's grandmother, Loretta Banks, is asking the court to transfer custody to another agency because they don't feel Trumbull County CSB is capable of providing adequate care.

Children Services officials disagree.

"I want CSB off the custody of the child. I want the grandmother to have visitation, and I want CSB attorneys off the case. The judge reserved jurisdiction and reset it for March 7," Engler said. "And there was also quite a tussle up front as to whether the media should be allowed into the courtroom. The judge said it is going to be open to the public, and it is my point of view that only bad things happen in the dark."

The infant's biological parents have been indicted on rape charges and are awaiting trial.
