A federal judge will let death row inmate Mark Brown challenge Ohio's lethal injection system, but it does not mean next week's execution will be delayed.

Brown is scheduled to die next Thursday for killing two people at a Youngstown convenience store in 1994.

U.S. District Judge Gregory Frost is letting Brown join a lawsuit that challenges the state's new lethal injection procedure.

The judge hasn't decided yet if he will delay the execution.
