A trial to challenge Ohio's death penalty got underway Monday in U.S. District Court.

The proceedings are part of condemned killer, Kenneth Biros' challenge, of the state's lethal injection process.  Biros says some of the drugs used will cause a painful death. The state says there's little evidence of that.  Testimony is underway to determine whether Biros can proceed with a full-blown constitutional challenge of Ohio's execution procedures.

Biros was sentenced to die in 1991 for murdering and dismembering 22 year old Tami Engstrom of Brookfield.  He later spread parts of her body in Pennsylvania.

I can't believe the court is going to waste money on this hearing! I hope he dies a painful and horrible death and this case doesn't go on too long so the family can feel some closure. We should just get back to the days of hanging.

You are SO correct Fatal, when I read the story I was like... he did not care when he murdered and cut her up, so why should he get any sympathy?? He deserves to die by lethal injection.

Who cares if it's painful!! Biros didn't get on death row for helping little old ladies cross the fricken street!! He got there by inflicting PAIN on another human being!!! Do you think he was honestly thinking about how much physical pain Tammy had to endure?? I think it should be "an eye for an eye" !! Her family should be allowed to take that idiot out behind the prison for a few hours, alone! He'd be begging for lethal injection by the time they got through with his sorry a#%!
